1. Definitions

• "Practice" / "We" / "Us" — Pusaka Adil, a legal practice registered in Malaysia, operating from Lorong Burma 21, 10050 George Town, Penang.
• "Client" / "You" — any individual or party who engages the Practice for legal services or uses this website.
• "Services" — legal services provided by the Practice, including estate planning consultation, probate and administration support, and contested inheritance assistance.
• "Engagement Letter" — the written agreement setting out the scope, fee, and terms of a specific matter.
• "Website" — the Practice's website accessible at pusakaakadil.blog.
• "Matter" — a specific legal instruction accepted by the Practice from a Client.

2. Acceptance of Terms

By using this Website or engaging the Practice for legal services, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

These Terms apply to use of the Website. The terms of each client engagement are primarily governed by the relevant Engagement Letter. Where the Engagement Letter is silent, these Terms apply.

3. Services

Pusaka Adil provides legal services in connection with inheritance and estate matters, including but not limited to:

• Estate planning consultation and will drafting
• Probate and estate administration support
• Contested inheritance assistance — negotiation, mediation, and representation

Services are provided in Malaysia. The specific scope of each engagement is defined in the Engagement Letter. We do not provide services in areas of law outside inheritance and estate matters. Nothing on the Website constitutes formal legal advice; that is provided only within a formal engagement.

4. Your Responsibilities

As a client or website user, you agree to:

• Provide accurate, complete, and timely information and documents as required for your matter
• Notify us promptly of any changes to information you have provided
• Use this Website only for lawful purposes
• Not attempt to reverse-engineer, copy, or scrape content from this Website
• Not engage in conduct that is misleading, defamatory, or harmful in connection with our services

We are not responsible for delays or adverse outcomes resulting from incomplete or incorrect information provided by you.

5. Intellectual Property

All content on this Website — including text, layout, design, and materials — is owned by or licensed to Pusaka Adil. You may not reproduce, distribute, or commercially exploit any part of this Website without our written permission. 6. Fees and Payment

All fees are set out in the Engagement Letter and are denominated in Malaysian Ringgit (RM). Work does not commence until the Engagement Letter has been agreed and, where required, a deposit paid.

• Payment is due within 14 days of invoice unless otherwise stated in the Engagement Letter
• Fees for additional or unforeseen work will be discussed and agreed before that work proceeds
• Disbursements (court filing fees, land search fees, etc.) are payable separately and are not included in the stated service fee unless explicitly noted
• Overdue invoices may incur late payment charges at the rate of 1.5% per month

Website fees listed (e.g., "from RM 265") are indicative starting points only. The actual fee for your matter is confirmed in the Engagement Letter.

7. Service-Specific Terms

Scope and Changes

The scope of each engagement is defined in the Engagement Letter. Any material change to scope — such as additional properties discovered in an estate, complications arising from a contested will, or new instructions — will be discussed and confirmed in writing before additional work proceeds.

Timelines

Timelines for probate and estate matters depend partly on the responsiveness of third-party institutions and courts. While we work diligently to progress matters without delay, we do not warrant specific completion dates unless expressly agreed in writing.

Confidentiality

All client information is subject to legal professional privilege and our professional confidentiality obligations under the Legal Profession Act 1976 and the Malaysian Bar's practice directions. We will not disclose your information to third parties except as necessary to carry out your instructions or as required by law.

8. Disclaimers

Information on this Website is provided for general information only. It does not constitute legal advice and does not create a solicitor-client relationship. You should seek formal legal advice specific to your situation before acting on any information provided on this Website.

Legal matters involve outcomes that depend on many factors outside our control, including court decisions and the conduct of other parties. We do not represent that any particular result will be achieved.

9. Limitation of Liability

To the extent permitted by law, our total liability to you in connection with any matter shall not exceed the total fees paid by you to us in respect of that matter.

We are not liable for indirect, consequential, or special damages arising from the use of this Website or from the provision of legal services, except to the extent that such liability cannot be excluded under Malaysian law.

10. Termination

Either party may terminate an engagement on reasonable written notice, subject to the terms of the Engagement Letter and the Practice's professional obligations. You remain responsible for fees for work carried out up to the date of termination.

We may decline or terminate an engagement if we are unable to act due to a conflict of interest, professional conduct requirements, or circumstances beyond our control.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Malaysia. Any dispute arising from the use of this Website or from our services shall be subject to the non-exclusive jurisdiction of the courts of Penang, Malaysia.

Where a dispute arises between you and the Practice regarding fees or service delivery, we encourage you to contact us directly first. If the matter cannot be resolved informally, either party may refer it to the Malaysian Bar's Disciplinary Board or pursue the matter through the courts.

12. General Provisions

• Entire agreement: These Terms, together with any Engagement Letter, constitute the entire agreement between you and the Practice in relation to their subject matter.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force.
• Waiver: Failure by the Practice to enforce any provision does not constitute a waiver of that provision.
• Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights to a successor practice.
• Notices: Notices to the Practice should be sent to the address below or to [email protected].

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Your continued use of the Website after changes are posted constitutes acceptance of the updated Terms.
